The Marfan Foundation's Bequest Language

THE MARFAN FOUNDATION ANTOINE MARFAN LEGACY SOCIETY
recognizes those who are building a personal legacy that reflects the priorities of their lives and funds those priorities far into the future. All planned giving donors receive membership in the Society.

Establishing Your Estate Plans

Making a planned gift can be as easy as adding a codicil to your will or filling out a beneficiary form for your retirement plan. When establishing your estate plans, always consult your personal professional advisor to ensure your plans accurately reflect your wishes while protecting your current income and providing for your family in the future. For more information on acceptable gifts, please be sure to reference the Foundation's gift acceptance policy. For your convenience, below is sample bequest language outlining how to include The Marfan Foundation in a will or trust.

Specific Bequest: I give, devise and bequeath _______________ (insert dollar amount or item of property to be donated) to The Marfan Foundation, Inc., or its successor organization, a nonprofit corporation as described in section 501 (c)(3) of the Internal Revenue Code with national headquarters located at 22 Manhasset Avenue, Port Washington, NY 11050, (Tax ID: 52-1265361) to be used for its benefit.

Residuary Bequest: I give, devise and bequeath _______________ (insert % amount) of all the rest, residue and remainder of my estate to The Marfan Foundation, Inc., or its successor organization, a nonprofit corporation as described in section 501 (c)(3) of the Internal Revenue Code with national headquarters located at 22 Manhasset Avenue, Port Washington, NY 11050, (Tax ID: 52-1265361) to be used for its benefit.

Restricted Gift (Specific or Residuary) Bequest: I give, devise and bequeath _______________ (insert dollar amount, item of property or % of residue) to The Marfan Foundation, Inc., or its successor organization, a nonprofit corporation as described in section 501 (c)(3) of the Internal Revenue Code with national headquarters located at 22 Manhasset Avenue, Port Washington, NY 11050, (Tax ID: 52-1265361) to be used exclusively (insert restricted use language here-such as for research, for children's programs, etc.)

Contingency Gift: Takes effect only if a primary intention can't be met.

If (name of beneficiary) does not survive me, or shall die during the administration of my estate, or as a result of a common disaster, then I give to The Marfan Foundation, Inc., or its successor organization, a non-profit corporation as described in section 501 (c)(3) of the Internal Revenue Code with national headquarters located at 22 Manhasset Avenue, Port Washington, NY 11050, (Tax ID: 52-1265361) all of the rest, residue, and remainder of my estate, to be used for its benefit.

Safety Language: Language added whenever a gift is restricted. In the event that the intent and purposes of the restriction, in the opinion of the Board of Directors of The Marfan Foundation, can no longer be served, the Board may devote any remaining assets exclusively for charitable purposes that: (a) are within the scope of the charitable purposes of The Marfan Foundation; (b) most nearly approximate the original intent and purpose of the gift; and (c) benefits charity. In the case of permanently restricted funds, this would apply to the income from these funds.

Estate Settlement After Death

When the maker of a will or trust or other beneficiary designation (such as life insurance, retirement assets, annuities, etc.) dies and the Foundation is named a beneficiary, the person responsible for distributing the bequest/gift (executor, trustee, attorney, etc.) should contact the Sr. Director of Finance and HR at 516-883-8712 ext 121.

The Marfan Foundation understands that this can be a difficult and painful time for family and friends of the deceased who are charged with administering the estate or trust. While we are extremely grateful to receive these gifts, we do often have to ask for copies of documents, inventories and/or accountings in order to comply with Generally Accepted Accounting Principles (GAAP) and audit requirements in order to maintain our nonprofit status. Additionally, this information helps us ensure that we are honoring the deceased's wishes as to any restrictions placed on his/her gift.
